Neighbor Removed My Fence

Ha! The wife just left me a message letting me know they just got ahold of the installer, it being his busy season and all, and at some point next week he's going to come look at the fence and fix the gap.


Um, he's also going to rip out the posts and put in a new fence in my yard. Jerk.
You need to let them know that just fixing the gap is not an option. Let them know you expect the fence, which was wrongly removed, to be replaced. You want the old posts removed from the ground and the fence to be like it was before.

What did the installer say that came yesterday?

As long as the fence was on your property you should have no problem with any legal matters. Them coming onto your property and removing your fence is no different than them coming onto your property and taking down a building.

Try your best to be super nice to them throughout all of this, even though you really don't have to and they're in the wrong! Good fences make good neighbors, but being super nice to people who are already going to be on the defensive also makes good neighbors.
I totally agree with this. They made a mistake that is fixable, as long as they put the fence back to it's original state. Try to not let a mistake become an ongoing war. It could make all your lives miserable. No point if it can be avoided.

This is what I'm really trying to do. So far, it's been good. My main worry is that they would try to hurt Maggie-and then you all would see a very not good picture of me on the news.

I'm going to call her back, since I have her number now and let her know it's not going to fix the issue.

The estimate the installer gave me yesterday was $1305 to put in a new fence ( 58 feet worth of 6 foot tall stockade fencing ) and to dig the posts out of the yard. He was even a little perplexed about why it was done.

I totally hear you on that. There's a neighborhood dog that has attacked Loki three times (while Loki was with me and the other dog was roaming in the street off-leash with no owner in sight). I called the police and reported it the third time, and when I went over to inform the homeowner she was VERY aggressive and demanded to know which dog was mine and where I lived. I refused to tell her and I stayed home from work the next day with Loki. If something weird happens to him while I'm at work...so help me if I won't burn their house to the ground.

Did you get a written quote? I'd make a copy and give it to her. Tell her you will take legal action if she and her installer does not fix it to suit you. Did you have a 6 ft stockade fence before? If not then you can only get the money for what it would be to replace what you had.

Yep, that's what I had, and that's what I want. He's faxing the estimate, and they will get a copy.

Keep us posted. It should be an open and shut case if you have to go to court. If they do drag it to court I'd be after attorney fees and court costs. Unless you have to go to small claims court then you may not get costs depending on your state.

No one can come on your property and take down anything. If so, maybe you should have their house removed!!
